How long does it take to get a divorce?
The state of Texas requires you wait 60 days after your Original Divorce Petition has been filed. It takes our office approximately 2-3 business days or sooner to gather your information and file, depending on how soon our clients provide us with the information we need. Total time until divorce finalization is approximatly 61 days.
If I live in another state, but my husband lives in Texas, and we were not married in Texas, can I file a divorce through your office, and in the state of Texas?
Yes. As long as you, or one of the parties reside in Texas and has been in Texas for more than 6 months.
Me and my spouse have been separated for several years and I want a divorce, but I can find him/her, can I still get a divorce?
Yes. We will do a diligent search for the other party (additional charge under our low cost divorce program). We will have to prove to the court that we did a diligent search. If we cannot find the other spouse, we will enter a motion for alternative posting. This means that we can post citation on the un-found spouse at the court house, the newspaper, or the last know address of the other spouse. After posting alternatively, we are required to wait 20 days the following Monday. If after the 20 days the other spouse has not responded, we will proceed with your divorce without him/her and finalize. Please be advised, if there are children involved, and you cannot find your spouse, the court may appoint an Amicus Attorney to find your spouse. If this occurs, you will be required to pay that Amicus Attorney $400.00 to $500.00 in addition to what you have paid our office.
Me and my spouse have agreed on our divorce and we have decided that I will not ask for child support, is this OK?
Yes and No. Child support is Texas Law. If you and your spouse agree to 50/50 and Joint Custody of the child and both agree to pay all expenses while that child is in your possession, you can ask the court to waive child support. However, a child support order still has to be submitted to the court but will not be enforced.
Will one of us be served citation by the Constable?
NO. With our program we will provide the other spouse (Respondent) with a WAIVER OF SERVICE, he/she will sign and notarize it. The Waiver simply says, I agree and are aware of the divorce proceedings and do not want to be served. This saves our clients $150.00, stress, and possible embarrassment.
Do I have to show-up in court?
YES. The party listed as Petitioner on the divorce will have to attend the prov-up (finalization). If the Petitioner can not appear for their hearing, the Respondent may appear if both agree. However, the Petitioner needs to be aware that if the Respondent appears and starts disagreeing with the Decree, the Judge will through out your divorce.

YES: We can send Him or Her the documents and the Facility where they are incarcerated should have a Notary available, they can sign the documents and mail them back to us.
